XIV. Terms of Service - Local Phone Plus & Digital Phone

This section applies to all Execulink phone customers who DO NOT live in the following areas: Burgessville (424), Woodstock (456), Norwich (468), Port Franks (243), and Thedford (296).

1. Competitive Local Exchange Carrier (CLEC) Certified

Execulink Telecom offers Services pursuant to the rules and regulations established by the Canadian Radio-television and Telecommunications Commission (the "CRTC") specifically, the decision on local service competition being Decision CRTC 97-8, Local Competition, 1 May 1997 (Decision 97-8) and other related decisions, orders and regulations issued or that may be issued by the CRTC. Execulink Telecom's network is connected to other local Canadian carriers, telecommunication service providers or their agents/resellers that offer service in Execulink Telecom operating territory.

2. Long Distance and Operator Service

a) The Customer's use of operator assisted local or long distance Services, directory assistance, toll-free Service numbers, collect calls and bill to third party calls charges are unrelated to choice of long distance provider and the Customer agrees to pay for all charges associated with such use from the Customer's Premises, lines or Internet connections. Execulink Telecom does not offer international operator assistance.

b) By acceptance of Execulink Telecom long distance or other usage-based Services, the Customer authorizes Execulink Telecom to make the necessary changes to reflect the Customer's decision to subscribe for same. In most instances the Customer dials 1 plus the area code and the Customer's call will be carried on behalf of the Customer on the Execulink Telecom network. The Customer also agrees to Execulink Telecom handling of all long distance calls and usage based Services as referred to above and will be responsible for, and agrees to pay for all long distance calls and usage based Services made from the Customer's Premises, lines or Internet connections.

3. Consumer Safeguards & 900 Services

While Execulink Telecom makes every reasonable effort to identify and avoid long distance fraud, the Customer is responsible for the calls originating from or accepted on the Services or the telephone line(s) and any charges associated therewith. Therefore, it is the Customer's responsibility to inform all users of the Customer's telephone lines at Customer's Premises that are subscribed for and acquired by the Customer and for all calls dialed on or accepted on the telephone line or Services to be aware of the risks associated with use of the Services. PLEASE BE AWARE that Long distance fraud or hijacking can occur when the Customer dials a number or accepts a call that is intercepted by a third party with the intention of making fraudulent use. A computer connected with a modem to a phone line can be a source of toll fraud. The Customer is solely responsible for the use, for allowing others to access and to safeguard the use of all equipment located at the Customer's Premises and for the use of the telephone line(s) and Services subscribed for from Execulink Telecom. For safeguard purposes, Execulink Telecom protects its customers by automatically blocking long distance calls to countries that are known destinations for long distance fraud.

4. Re-Termination of Circuit

In the event that the Customer requests a re-termination of its circuit (relocate the termination point of the telephone company's dedicated leased line at the Customer's premises), the Customer will be responsible for all fees assessed by Execulink Telecom and the telephone company. Execulink Telecom will not be responsible for any disruptions to the Services caused by any such re-termination.

5. 911 Emergency Services

Execulink Telecom delivers two forms of 911:

a) Enhanced 911: Execulink Telecom’s Enhanced 911 emergency service is the same as the enhanced 911 service (e911) or traditional 911 service that is available in most locations in combination with traditional wired telephone service. This means that your call is sent to the nearest emergency response centre. The nearest emergency response centre is determined by the address you have registered with Execulink Telecom. The address and telephone number that is registered with Execulink Telecom will be visible to the e911 operator that receives your call. Should you be unable to speak during an e911 call, the e911 operator will dispatch emergency response vehicles to your last registered address.

b) Limited 911: With Limited 911 your 911 calls will be routed to a national emergency response centre.
National emergency response centre operators do not receive your phone number or civic address. The 911 operator will request your address and telephone number and then transfer your 911 call to the emergency response centre nearest your current physical location.

Limited 911 emergency services are only in effect under the following conditions:
If you use a Phone Adapter, an IP Phone, a SoftPhone, or any device that makes your digital phone service portable to different geographic locations;

AND

You move your phone service outside of the Execulink Telecom CLEC service area.
If you have not notified Execulink Telecom that you are utilizing the mobility component of your digital phone service, your 911 call may be routed to the incorrect 911 emergency response centre. You must ensure your civic address is kept current with Execulink Telecom at all times.
